As a profound revolution in the 20th century, the network storm which engulfed the entire world changes people's life. Transaction on network is convenient, quick, low-cost and efficient. Therefore it becomes the center of economic life in the 21st century. However, the virtuality of the cyberspace also makes it show differences from the traditional transaction. The most irritating is nothing better than the authenticity of information and its security in transmission, which is seriously restricting the development of electronic commerce. In this situation, establishing a system to guarantee the authenticity of information and the accuracy of both sides, in order to guarantee the electronic transaction's security, authenticity and reliability, becomes the most important thing to solve. The electronic authentication emerges in this specific background. The electronic authentication plays the role as a bridge. It works in the way that the third party which all trusts proves the authenticity of information, and dispels the other party's anxiety. For this reason, the electronic authentication is in the core position of the entire electronic commerce environment. Establishing a perfect electronic authentication system becomes the foundation on which electronic commerce can develop. It is also a powerful safeguard to the electronic commerce's fast development.Focusing on the research of this subject, this thesis starts with the reason for production, analyzes relevant foreign legal systems, and introduces the major approaches of legislation of electronic authentication in detail. Then it analyzes several important legal issues involved in electronic authentication by employing basic theories of civil and commercial laws. In the light of the status quo of the electronic authentication industry, the last part of this thesis evaluates the success and insufficiency of "Electronic Signature Law" and "Electronic Authentication Service Regulation", and specifies several exploratory suggestions for the improvement of our legal systems of electronic authentication.There are five chapters in the thesis.
