Study Of The Problems Of Accepting Bribes

The writer in this paper will take some problematical issues on the crime of accepting bribes into consideration, in view of the theory of criminal law as well as the practice of criminal adjudication. These problematical issues including the subject of the crime of accepting bribes, "taking advantage of one's position", "securing benefits for anther person", "illegitimate benefits" and as joint offenders in the crime of accepting bribes. On this basis, the writer aims at examining the intention of criminal legislation, seeking-after rational solution for the issues in discussion, thereby contributing to the perfection of legislation and giving guidance in judicial practices.
