After Taiwan became a member of WTO as a separate tariff zone on Jan,1,2002, there are four members of WTO in a certain country, China. As a result, the economic was to develop in a new way. That's why Taiwan adjusts its policy about the capital from mainland of China which are invested into Taiwan. But there are still a lot of restrains and discriminations. It is possible for Taiwan and the Mainland to invest into each other for the custom of the country and the emotion of the people. As well as Hongkong and Marco, Taiwan is an essential part of China, whose economic business with the Mainland is treated as the foreign business because of its different political and economic structure. The economic of the Mainland is developing fast and the policy made by the government is encouraging the capital to be invested abroad. So that the capital from the Mainland is invested into Taiwan is of feasibility.However, in account of the political purpose the authorities of Taiwan take many measures to prevent the capital from the Mainland to be invested into Taiwan, such as the legislation and the application of the exception of WTO rules. We have to analyze these measures and find the solution against them.How to take the contingency measures against them is also significant in theory and fact. Taiwan and the Mainland are both in the same country, and both the members of WTO, that makes the relationship between them special. How to treat this special relationship properly is a new subject which involves problems in politics, law, and economics.This article includes 5 parts.1. Introduction. It introduces the general situation of the investment between Taiwan and the Mainland, containing the change of Taiwan's policy about the economic business with the Mainland, the revision of Taiwan's legislation about the capital investments from the Mainland, and a system of data about the movement that people of Taiwan invest in the Mainland. The author also introduces the basic situation that the companies with the capital investments from the mainland invest in Taiwan. The investments between Taiwan and the Mainland are one-way and indirect.
