Notary System Of Civil Liability Study

The notary's responsibility system is a key component of notarial systems, and the notary civil responsibility is the kernel and basis of whole notary's' responsibility system. It has function to balance the interest relation between the notary and his clients, restrict the power of notary and give effective and efficient remedy to the clients. So it has great significance for the safeguard of the social justice and fulfilling the functions of the notarial system.This thesis consisted of seven Chapters, to study the system.Chapter 1: The concepts and basis of system.Stressing on the introduction to the origin, history of notarial system, and further the basic concepts. Through the analysis to the feathers and various facts effecting the formation of the notary's responsibility system, reached the conclusion that is a special kind of tort responsibility. Referring to the facts of notarial system reform, analyzed the theoretical and legal basis and significance of the establishment of the system in China.Chapter 2: The concept and features of the system.This chapter is about the characters of notary's civil responsibility system. Through the studies on the facts that impact the contents of notary's civil responsibility, find out the the characters of notary's civil responsibility system, and reaches the conclusion that notary's civil responsibility belongs to a special professional tort responsibility.Chapter 3: The studies on the legal and theoretical basis of notory's civil responsibility.In this chapter, through the studying on the nature of notary's civil responsibility, referring to the facts of notarial system reform, the theoretical and legal basis and significance of the establishment of the notary's civil responsibility system in China, reached the conclusion that the notary's responsibility system is a kind of experts' responsibility.
