Administrative Public Interest Litigation System Construction

The administrative litigation on public interests means such a proceeding that when an administrative act infringe the public interests, some citizens, other social organizations who may be irrelevant with it, or the legal supervisor of state filed an action and the judge conduct it according to due procedures. This article gives an analysis on how to build our administrative litigation on public interests in three chapters. The first chapter makes a probe into the general theory of the administrative litigation on public interests which includes the meaning of public interests , the meaning and history of the administrative litigation on public interests ,it 's basis in legal theory and the relationship between the litigation on public interests and the administrative litigation on public interests. The second chapter analyze the practices of administrative litigation on public interests in some countries, then gives the same feature of this rule and necessity ,feasibility of building rules of the administrative litigation on public interests , The last chapter designs the concrete issues about the administrative litigation on public interests, gives a detailed analysis on the seven issues such as the qualifications of plaintiff ,scope of the cases that the Court will accept and the procedure issue before the action is filed etc. In our country it is important and valuable to study the administrative litigation on public interests .we must build the administrative litigation on public interests system as soon as, and at the same time we should draw lessons from the foreign countries with success experiences, so as to protect the national benefits and public benefits. In this way not only can we perfect the administrative litigation system, promote our government conduct in legal track but also we can accelerate the pace of building a country ruled by law.
