Research, A Number Of Issues On China's Cooperative Legislation

This paper proposes that it is urgent to formulate "The Cooperative Law" in view of the cooperative economy develops rapidly in our country and needs to be ruled, but cooperative legislation remains a blank in China. This paper also put forward the concrete legislative propositions. It includes four parts:The first part, introduces the history of cooperative and its developments in the world at present, and analyzes the reasons that cooperative is prosperous.The second part, analyzes the current questions and the reasons in view of development in our country, and probes into the necessities of formulating "The Cooperative Law" as soon as possible.The third part, comparatively researches into "The Cooperative Law" of other countries, and analyzes the enlightenments by their legislation practices.The fourth part, proposes the concrete legislation suggestions of "The Cooperative Law", including the attribute of cooperative, the principle of cooperative, the type of cooperative, the governance structure of cooperative, its status of legal person, legislation pattern of "The Cooperative Law" and so on.
