Although our country patent presents aform of explosive growth, the innovation ability is also very seriously, but there is nocorresponding patent quality and the development of China’s overall innovationability is not high.This paper introduce the present patent law system and the analysis of the policy,past research focuses on summarizing domestic patent, patent application andauthorization, invalid conversion rate and the distribution of data, through the data toillustrate the status quo of China’s patent quality and severity, and in this paper, on thebasis of these data research, emphatically from the applicant, the franchisor,authorization conditions these three aspects to analyze problems, through specific datashown to illustrate the patent quality present situation, and analyses the our countryand the United States on the applicant, as well as the similarities and differences ofthe franchisor, conditions of authorized legislation, and finally from the three aspectsemphatically put forward specific legislative proposals.Through research, this paper reveals the current our country patent quality aboutthe trend of development, show that with the steady growth of China’s patentapplications, patent quality in our country will be more behind its number of growth.Authorities in China have focused on patent quality problems of their own, andestablished some relevant policies and measures. America’s patent systemdevelopment is relatively perfect, therefore in the comparison with the United Statespatent legislation analysis, this paper draws on relevant laws, regulations and policiesto improve the quality of patents in the United States, at the same time explore withinthe scope of the adapted to China’s national conditions out of a patent system of their own development path.
