Credit is the foundation stone of market economy and interior quality of the society governed by law. Information dissymmetry in market economy results in some negative effects such as prisoner's dilemma, moral risks and contrary choice, which worsen the social economic order. The Personal Credit Reporting System will change the information dissymmetry between principal parts of the market. The Personal Credit Reporting System has important essential institutional values not only on the prosperity and stabilization of market economy, but also on founding credible and harmonious society. But because of the natural conflict between the Personal Credit Reporting and the protection of the right to privacy, how to protect the right to privacy in the process of credit reporting became an important problem of legislation. Especially when the WTO interim is about to past and the Credit Reporting industry is about to open to the outside world, the domestic Credit Reporting industry will waste great social costs because of the lack of legislation on protection of privacy. Moreover, the internationalization of privacy protection forms new covert trade barrier, which will baffle the progress of our Credit Reporting industry. Thus, it's vital to perfect privacy protection legislation.This paper is trying to study by two routes: First, for the purpose of finding out the cause and effect of this problem , the paper discusses the signification and institutional value of the Credit Reporting system and analyzes the conflict of Credit Reporting by way of perspective of the legal relationship of credit reporting. Second, on the basic of comparing the legislation of UN and US and analyses of the economic evaluation of the legislation enforcement, this paper criticizes the deficiencies of domestic legislation on privacy protection in the credit reporting system and put forward some legislation perfection advice.The full thesis is divided into four chapters besides the preface and postscript.Chapter 1 is the introduction of personal credit reporting. It begins with the connotation of "personal credit" and "personal credit reporting system". In addition, it analyses the value of personal credit reporting in economics and sociology, and the development of domestic personal credit reporting system.
