Since the continental shelf system produced, the delimitation of its boundary then become a big problem in the law of the sea. The most principal and direct factor of the continental shelf dispute of Sino-Japanese in the East China Sea, should be this area contains a great deal of oil resources, and then because of the establishment of continental shelf system, this dispute has already brought into the adjustment frame of the sea laws. This article is from the visual angle of the international law, and analyze to the typical cases and principles of maritime boundary delimitation, probe into the guiding function of the practice and international law principles to East China Sea dispute, and discuss the disputed focus, disprove the Japanese standpoint, put forward our strategy and the program in this dispute. By this article, in order to provide way of thinking for the dispute resolution in East China Sea.In addition to the preface and the postscript, the full text is divided into four parts:Part one, cause and present situation of the dispute in East China sea. Generalized the reason, background and development of Sino-Japanese continental shelf dispute in East China sea.Part two, the practical development and international law principles for continental shelf delimitation.Through analyze the delimitation practice and typical cases, deepen our understanding for this problem, and also find many judicial precedent opinions; through the analysis of delimitation principles, we know that "equitable principle" is the fundamental principle for intermational maritime boundary delimitation, the "equidistance line" and "natural extension" also applies under the principle of equitable, it resolving what principle shoud the dispute in East China Sea to follow.Part three, think of the delimitation under the international law. This chapter related the factors that should considered, contact Sino-Japanese branchings and bilateral claims , disprove the Japanese standpoint from the many aspects, such as the international law theories, the typical judicial precedent and from the history, the geology, geography etc., clear and definite that the continental shelf delimitation should adopt "equitable principle",and considering related factors, such as coastline, islands and the sea valley etc., and reaffirm our...
