Modem international factoring is an integrated financial service, which involves trade financing, collection of accounting receivable, maintenance of the sales ledger and credit security. In nowadays, international trade is developing very fast and the "buyers' market" is also coming into being, which leads to the widely application of international factoring. International factoring involves several parties, among whom exist complex relationships involving each parry's rights and duties, so it is important to analyze and regulate it legally. At the same time, it is also necessary to give international factoring an exact market orientation for its healthy development After all, the ultimate purpose of this thesis is to perfect the legal system and promote the development of international factoring in China. Except the introduction and the tag, mis thesis includes five parts:Part One: Sketch of factoring. Introduce the history, definition, classification and operation of factoring, then give a brief introduction on the international factoring organizations as well as corresponding international legislation, finally use relative data to analyze the current development both at home and abroad.Part Two: Legislation Analysis. Arguing about several traditional theories about the legal basis of international factoring, on the basis of which put forward that the assignment of accounting receivable theory is more reasonable, then discuss the concrete legal issues of assignment of accounting receivable, finally expound the legal relations among the international factoring parties.Part Three: Legal System and Justice Practice in China.Part Four: Advantages and Limitation. Represent the advantages of international factoring compared with other traditional trade settlements, men give international factoring a market orientation after comparing it with other similar financial services.Part Five: Development in China. Analyze the necessity of developing international factoring in China through two significant cases, then summarize the obstacles in our country and bring up corresponding counter-measures and suggestions.
