Study Abroad On A "non-market Economy" In China's Dumping Prosecution

Chinese market economy has come into being after more than twenty years' construction. Because of various factors, the development of Chinese market economy status has not been approved by chief western countries. Therefore they regard China as a non-market economy country in the cases of anti-dumping and apply "surrogate country" as the criterion in adjudicating anti-dumping case, which brings forth much difficulty to Chinese enterprises' reply to accusation.The following is the major viewpoints in the dissertation: by means of research on statute for both international organization and typical market economic countries and data analysis to China, it is concluded that China has been a developing market economic country, but not the mature one. Therefore, any accusation aroused with Non-market economy is not totally tenable. Through the analysis to the economic factors and non-economic factors for the anti-dumping accusation by developed countries, it is believed that China should promote the process of market economy as much as possible, in the meanwhile, China should firmly reply to any unreasonable accusation.During writing the dissertation, I mainly take the method of standard analysis, compare analysis and data analysis in research on the relative statute and the development of Chinese market economy. While discussing the enterprises in China, I establish an index system, which bases on the achievement of some relative scholars and the latest date available, to measure the market degree for the Chinese enterprises. It may have great influence in both economic and political field to solve "Non-market economy" problem.
