Great Britain and America's trust legal system went through the unprecedented changes from the end of the 20th century on. Compared with traditional trust, there are three outstanding characteristics in modern trust: (1) The explosion of written laws breaks Great Britain and American's traditional legislative style and the written law plays a more and more important role in contemporary Great Britain and America's trust. (2) Trustee's right is expanded . In order to meet the financial nature of the modern trust property and efficiency of management with the specialized demand, Great Britain and America has inspected again trustee's right system of excessive restriction of traditional trust, the overall trend of trustee's right is on the increase. (3) The modern trust system is established. In order to meet the trend that trustee's right expands, it is the system of central modern Trust Law that modern Trust Law has been set up with " faithful , prudent ", in order to evade the risk that the trustee abuses the right.Modernization of trust is an important theoretic and practical task for the 2 legal systems to finish. The goal is to make it become more safe and efficient than traditional trust system . This paper is mainly based on Great Britain and America's trust legal system because of their going ahead.The modernization of trust legal system focuses on the modernization of trustee's rights, especially on the trustee's investment right and delegation right.
