The modern constitutionalism movement is the achievement of modern capitalist revolution. Therefore, it is significant to study the historical and cultural mechanism of the making and development of modern western constitutionalism movement, and thereby to provide helpful enlightenment for the construction of constitutionalism in China. We should affirm historical advancement of the bourgeois the theory of human rights, and the rights of surviving and development of human rights. At last, we analyze the reason of the defect and give some advice about how to eliminate the defect and to propel the development of process of law of China.
