The idea of real right is originated from the Rome law, but real right as a kind of technical terms in law was defined in the .The tradition of real right as a kind of thoughts was inherited and developed by Continental law system countries, and they also developed it perfectly. At the same time, these countries founded many theories. However, the real right was not restricted in the civil field .we should give up the tradition .the real right in Administrative law is different form the real right in Civil law. It is a sort of right ,the administrative subject hold, use, manage and handle the public property by the administrative power. The system was developed perfectly in France, and was introduced and developed by Japan, Germany and the Taiwan region of China.The article primarily studies on the real right in Administrative law, including six parts:the first part explains the causes and necessity of the subject, and also describes the presentacademic research on the subject in the Continental law system countries; the second partpays careful attention to the definition of the real right in the administrative law and itscharacters; the third part takes up the origin and development of real right theory inAdministrative law, in order to find the origin of theory; the fourth part is mainly centeredon the comparison of the real right between in the administrative law and in civil law. Theyhave many differences by comparison. So it is necessary for putting forward the real right inAdministrative law; The fifth part takes up the consists of the real right in Administrativelaw .studying on main issues about it; The last part comes to the purpose of this research.According to the state of our country and the reality of social development, the authordemonstrates the necessity of introducing the real right in Administrative law.
