May Fourth Movement Constitutional Theory

The constitutionalism in the May Fourth Movement dominated the main port of the trend of thought during the May Fourth period. It was the enlighten movement which was moved by the development of knowledge and it was on the base of rich knowledge groups in order to improve people's realization of the moral principles, the thought not only succeeded the democratic constitutionalism since the revolution of 1911,but also initiated a new trend of thought .What the scholars elaborated on the issues of thought and what the scholars elaborated on the issues of human rights, democracy, constitution ,etc, embodied the obvious characters of the era and the nation.The enlighteners' continuous exploration on the human rights formed one of the main parts of the constitutional and political thought during the May Fourth Movement .The thought on human rights at the beginning put its emphasis on the topics of freedom, equality and independent personality .And it rejected the feudalist rules and dictatorship which hindered the developments of Chinese personality and spirit The thought on human rights made programs with the influences of other thought groups and it enjoyed a new spirit -to survive at the end of the movement expounded the basic human rights, and theories which were on the basis of freedom and equality .combining the human rights with the constitution and comparing the human rights with the state power , and they paid their attentions to the individual's rights as well.The enlighteners always put the support to democracy together with the re-evaluation of the traditional cultures. They used the differences between the civil rights and human rights to make clear the relationship between Confucius theories and the constitution, rejected the autocracy from the equal rights and supported a system which allowed common people to share the state power.
