Advance Notice Registration System Research

Real Estate Predicting Registration Institution, as a special formation of Real Estate Right Registration, plays a very important role in protecting the interests of creditor. Since 17^th century, this institution has been widely adopted by many continental law system countries and regions, such as Germany, Switzerland, Japan and Taiwan Province of China. However, in mainland China, Predicting Registration is a relatively new institution. Although it will be introduced by the coming Property Law of China, the study on this institution is still on an early stage.Through summarizing the fruit of former research on this institution and consulting the legislation experience of Germany, Switzerland, Japan and Taiwan Province of China, this dissertation emphasized on the study of the quality, effectiveness, and alteration of Real Estate Predicting Registration Institution. And, according to the current situation, this dissertation also advanced a number piece of advices for the construction of the Predicting Registration Institution in China. This study took the Real Estate Registration of Continental Law System as a boundary and Predicting Registration Institution as the main research object; using a series research method, such as comparative analysis and economy analysis, tried to find out the internal principle of the structure of Real Estate Predicting Registration Institute. This dissertation composed by 6 parts, 40,000 characters.Part 1 is an introduction of Predicting Registration Institution, summarized the former research on this institution, concluded the definitions, characteristics and classifications of it, and compared this institution with Opposition Registration Institution. Real Estate Predicting Registration refers to that, party, when the conditions of real right alteration are deficiency or haven't been met, registers in advance for the claim of Real Right Alteration. The characteristic of Real Estate Predicting Registration is that the object of registration is not practical real right, but the claim of real right alteration.
