With the consistent development of the project of constructing a society governed by law in our country, the administrative compensation system has been a hot topic in the field of our administrative law. And it has also become an paramount undertaking to establish and perfect our administrative compensation system in the legislation work of our administrative law system. The article makes an preliminary study of the administrative law system of our country, basing on the relating essential theory of administrative compensation system and constitutional law, and the analysis of the developed administrative compensation law in foreign countries, and the combination of the analysis of both the practical situation and legislation of the country.In order to discuss and analyze the administrative compensation system of our country, the article is divided into 3 parts.Part one is a summary introduction of administrative compensation system. This part comprises two sections, in which, on the one hand the author try to give a clear description of the definition of the system of administrative compensation, on the other hand, in order to uncover the inner spirit and merits of the system of administrative compensation, so that a solid ideological foundation can be laid for the latter discussion of the amendment of such a system of this country, the author exposes the philosophical and constitutional foundation of administrative compensation system of our country, while the active role of individual property rights in such a system is also stressed.Part two is also divided into two sections, in which, the author analyzes current legislation situation of administrative compensation system of our country. In the first section, the author illustrates the history and the status quo of administrative compensation system of our country, while prominence is given to the latter, basing on which characters and achievements in the system is shown up. In the second section, the author exposes the defects of our administrative compensation system in regard of the analysis of the relevant system and theory of foreign countries.
