The Administrative Compensation System

If the infringing of legal interests of citizens, corporation and other legal organizations happens when the state administrative organizations or staffs perform their functions and powers illegally, the state administrative organizations should pay a loss for the interests. It is a long and difficult process from the administrative compensation system creation and development to final establishment. The active role in the development of society is played. The national compensation law is put into effect in 1995, so the administrative compensation system is established basically, but the full functions are not performed because of the limitation of the law and the development of society economy.The administrative compensation system becomes better in home and abroad, but there are also some problems that can not meet the requirement of the society development, it is necessary to study the administrative compensation system deeply. The first past introduce its conpect .This paper reviews the history of the administrative compensation system by means of comparative study and logical reasoning, the investigation on the administrative compensation system basic theory is founded. The current situation of the development and legislation about the national administrative compensation system employed in main capitalist country such as France, Germany, England, America is discussed in this paper. The Chinese administrative compensation system is analyzed in detail, and the analysis of the problems existing and the proposals that can improve Chinese administrative compensation system are made.
