The identity paradox of NPC deputy is produced when a government official as NPC deputy integrates the executive power and supervisory power. This article starts with the legal sources of law of the legal identity system of NPC deputies, analyzes the necessary and sufficient conditions for the formation of identity paradox of NPC deputy by means of comparison with the legal identity system of members of parliament as well as the study of the legal phenomena of the practical politics; and puts forward suggestions for the perfection of the legal identity system of NPC deputies.The article falls into four parts:I. Introduction to legal identity system of NPC deputiesThe source of legal identity system of NPC deputies can be traced back to the ancient Greece. The legal identity system of NPC deputies now under discussion directly stems from the practice of the Paris Commune. For the convenience of the study, we mainly discuss the constitutive requirements of the legal identity system of NPC deputies: namely the obtainment, rights and obligations of legal identity of deputy, the economic benefit of deputy during the office of term, and the dismissal and suspension of legal identity of deputy.II. Comparison between the legal identity system of NPC deputies and the legal identity system of members of parliamentBy comparing the constitutive requirements of the legal identity system of members of parliament of UK, France and USA and analyzing the reasons why no or less phenomenon arises from the identity system of members of parliament, the conclusion that the combination of legislative and executive powers of system of NPC deputies provides prerequisite for the identity paradox of NPC deputy is reached.III. The real causation of identity paradox of NPC deputyIn practice, the identity paradox of NPC deputy is formed on the following four grounds: first, the misrepresentation of the combination of legislative and executive powers of system of NPC deputies; second: NPC deputies being composed of CPC members and government workers; third, the difference in fairness of delegacy, and forth: the disordered interests of NPC deputies.
