Gangland Crime

Organized crime appears in China means that social crime has transformed from traditional crime to modern crime. Its destructive function has increased greatly. It is very meaningful for proper and scientific recognition of its content to study the characteristics, prevention and cure of organized crime. Organized crime in China is becoming increasingly tight, mutual penetrate with corruption, international and more intelligent. We should distinguish organized crime with terrorist organization, criminal groups, cult organization, illegal armed groups and evil group. Leadership, Participation in Organized Crime, Immigration Development in Organized Crime and Protect and Connive in Organized Crime are different in definition, constituent element and justice determination.By analyzing the legislation of organized crime in different countries and regions, we find that the principal part of legislation is common part, purposely offense in subjective fact, behavioral offense in objective fact and special stern on penal sanction. We elaborate the current error of legislation: lack of completion in offence provisions, pertinence in setting up of provisions, science in setting up penalty. So we suggest that the current legislation in China should add new crime, fix statutory crime, enhance sentencing range, add property crime, build anti-organized crime procedure and strengthen international justice cooperation. To reduce spiraling organized crime, we should strengthen international police cooperation, intensify the punishment of shielding organized crime, and narrow space of organized crime.
