China, as a contracting party to the "United Nations Convention against Transnational Organized Crime" (hereinafter referred to as "the Convention"), has formally ratify it. To guarantee effective implementation of "the Convention" is our obligation, but comparing the provisions and requirements of the "Convention" with our (only refers to the China mainland) of the existing criminal law provisions on organized crime, some differences and gaps can be found between them. Although organized crime, organized crime works have been discussed much , their definition of the concept of content varies, to combat and prevent organized crime methods, means different perspectives, which is not conducive to China to effectively combat and prevent organized crime, also to a certain extent, restricted the "Convention" in our implementation. In such cases, this paper aims to focus on "Convention," the requirements and spirit of the principles, so as to deeply improve criminal legislation of our country.The article first with "Convention," the introduction of background, describes the objective existence of organized crime in China, and then discusses the improvement of criminal legislation of China's need for organized crime.Comparing Domestic with international organized crime legislation briefly, it points out the inadequate of China's existing criminal law provisions against organized crime and the "Convention" requirements gap.On this basis, it analyses the improvement of China's organized crime from the two sides in the substantive law and procedural law .
