On Misappropriation Of Capital Crime In The Identified Problems

The crime of misappropriation of funds as one of the most common types of economic crime cases, as China's economic reform and modernization of enterprises and the development of the legal system to create a new type of crime.1997 Amendment "PRC Criminal Law" (hereinafter referred to as the "criminal"), the introduction of the provisions of section 272 of the crime of misappropriation of funds, which is the initial stage of socialism against crime requires legislative options. Currently, such crimes are moving towards a huge amount of money involved, the main crime intelligence, and extensive and complicated criminal means, such as developing diversified forms of crime, crimes against public security organs to bring a lot of new challenges. In this paper, combining judicial practice in criminal law theory as a guide, misappropriation of funds of the crime to the scope and objective elements of the composition, an accomplice in the crime of confirmation, the confirmation constitute criminal misappropriation of funds and the offense of perfect judicial practice there are a number of issues to study and exposition put forward my views and proposals.
