| With its entry into China in 2002, blog has enjoyed a highly-speeded wide spread and became the fourth communication tool on internet following E-mail,BBS and ICQ(IM).More and more people have established their blog space which serves as platform for communication with updated information.Due to its anonymity in transmission and reception,diversity in information form,blog, the newly-born favorite in internet world, while introducing freedom elements in speech and media reports, will definitely bring negative influence to the society. Ultra speech, void exaggeration, flooding faulty information are all the by-products of the blooming of blog.Therefore, justifiably, people begin to worry blog, to which there is no threshold, will probably become an uncontrollable site which breeds rumor, defamation and unreliable speech endangering the society.Using specific examples, this dissertation will introduce the various forms of torts and classify the tortfeasor and principle for imposing liability. In this dissertation, particular attention is paid on the intensively-discussed issue of responsibility of blog trustee. Due to the trustee's special status and its operation in promoting the newly-flouring blog, the policy of freeing it from some liability is suggested. After analyzing the current applicable law and regulation, the author put forward some suggestions to regulate the blog torts. However, the author is opposed to enacting a law which separately regulate blog actions. |
