On The Mechanism Of Implementation Of Corporate Social Responsibility

Topics on corporate social responsibility have drawn more and more attentions in the past several years. The explosion at the plant of Jilin Petrochemical Corporation and many other similar accidents which did great harm to the whole society inspired a comprehensive reflection of the corporate social responsibility. The purpose of this paper is to define the concept of the corporate social responsibility, analyze its rationality and necessity from three angles: economy, sociology and law, and most important of all, introduce the concept of corporate social responsibility realization system, and put forward constructive suggestions to realize the corporate social responsibilities from legal and moral aspects.This paper, consisting of four parts, mainly adapts the historic study method, cross-subject comparison study method and the case study method. In the first place, this dissertation defines the concept of corporate social responsibility and describes its features, introduces the history of corporate social responsibility, and analyzes its rationality and necessity from three angles: economy, sociology and law. In the second place, this thesis defines the concept of corporate social responsibility realization system and describes its features. The author points out that there are two different definitions of corporate social responsibility realization system, namely the narrow concept of corporate social responsibility realization system and the broad concept of corporate social responsibility realization system. The narrow concept of corporate social responsibility realization system only refers to the legal corporate social responsibility realization system, The broad concept of corporate social responsibility realization system refers to all those measures which are adopt to promote the corporation to perform its social responsibility positively. The corporate social responsibility realization system mentioned in this paper refers to the broad concept of corporate social responsibility realization system which contains the legal aspect of social responsibility realization system and moral aspect of social responsibility realization system. The third part of this paper introduces the legal aspect of corporate social responsibility realization system. After introducing the principle and some concrete laws and regulations of the legal aspect of corporate social responsibility realization system, this paper points out the awkward dilemma which the legal aspect of corporate social responsibility realization system is facing and some useful measures to deal with it. The forth part of this thesis introduces the moral aspect of corporate social responsibility realization system. After introducing some specific measures which are helpful to realize moral corporate social responsibility, this paper makes it clear that the awkward dilemma that the moral aspect of corporate social responsibility realization system is facing contains"material obstacle"and"mental obstacle"; this thesis also puts forward some constructive suggestions to deal with these obstacles.The realization of corporate social responsibility relies on reasonable and effective corporate social responsibility realization system. this realization system contains legal aspects of the realization system and moral aspects of the realization system, each of which has its own advantages and unavoidable and inherent disadvantages at the same time. only if these two aspects are harmonious and cooperative that they could promote the corporate to carry on its social responsibility positively. Another thing which should also be point out is that the realization system of our country is not complete, and it should be adjusted based on the situation of our own country from time to time .The adjustment of the corporate social responsibility system of our country is a long-term, hard and glorious task. In the process of establishing relevant system, special attention should be paid to the interest of the corporate. The law-makers should make good use of the guiding function of the law, and lead the corporate to perform its social responsibility more positively. Only in this way could we realize the harmonious development of the corporation and the society, and promote the sustainable development of the whole society.
