The Expert Witness System In China

Expert testing system is an important part of the judicial system. As judicial reform deepen , greater demands are made on reform of expert testing system. As the core of expert testing system, expert witness is the focus of the reform. The author makes a thorough approach and total respect of expert testing system after collecting material about expert testing system in foreign countries, in order to study the experience of other countries for expert testing system reforms in China.This article first analyze the general theory of the expert testing system from the concept of the expert, introduce the expert's concept, nature and status as well as the difference with relevant concept and so on. On this foundation, the author summary and appraise the present situation and the question of the expert testing system in our country. Through the self-examination to current situation and the cause of the problem of our country's expert testing system, this article put forward some suggestion on perfecting the expert testing system , such as unifies legislation, strictly establish qualification of expert, give the right to select the experts to the parts , clearly stipulate the right \right and liability, establish a system of expert's appearing in court. Then we can change our country's present situation of the expert testing system ,and establishes a scientific, fair expert testing system.
