On The Protection Of The Rights Of Victims Of Criminal Indictable Cases

This paper probes into the following issues. The first one, with regard to the protection rights of the person who is harmed in criminal cases, which undergoes its devious course. Attention paid on it varies from its historical development. With the defendant becoming the center of the lawsuit, currently, this issue is deeply concerned in theory and law fields once again. China, concurrently, establishes the status of the litigant when emending the Criminal Law, and endows the person who is harmed in criminal cases with a series of lawsuit rights. Affected by the traditional lawsuit concepts and national priority concepts, etc., along with such facts as the deficiency of China judicatory resources, however, there still exist such problems to sovle urgently during the implementation of the legistation and judicature as perfecting criminal proceeding, establishing national compensation system, maturing law reinforcement system, constructing the spirit compensation system of the person who is harmed in criminal cases, etc., simultaneously, problems exist between the person who is harmed in criminal cases and such three departments as police, prosecute and court in judicatary practice which are under settlement sooner.
