The construction of Chinese intellectual property system starts late. At present the protection of intellectual property rests on the civil and administration level. The number of criminal case that lodging an appeal is out of proportion to the number of administrative disposal and civil adjudgement. The function of intellectual property criminal judicatory protection doesnot exert fully. The tort of intellectual property aggrieves the obligee's individual as well as damage the social public interests and market economy order and the system of the social productivity. Penalty interposition should be taken when the tort of intellectual property is very serious and endanger the society and mere civil adjudgement and administrative disposal are not enough. When the tort of intellectual property transgress against the law it should be punished and the invader should take on corresponding criminal responsibility.To ravel out the tort of intellectual property by penalty and bring it into the investigation procedure is the ultimate criminal lawsuit and just intellectual property protection. The investigation of intellectual property case should be in the charge of public security of right. Then, what is the tort of intellectual property? This paper discusses the trick method and technique in the investigation of the tort of intellectual property briefly.The investigation of the tort of intellectual property is still in a passive and embarrassed situation because of the negative social attitudes, the loss of effective join of administrative and civil execution, the disunion of law understanding and application.
