Hence, it is urgent to reform the Chinese land collectivization system which involves the clarification of the purpose, rational land planning and improvement of reimbursement.With the developing of the society's productivity and industrialization, urbanization has been reaching the process of acceleration in our country. Because a series of changes of the relations between state-owned and collective-owned, the characters of using and economic connections,, It is important to probe in collective-owned land requisition.Starting with the history background of the land expropriation system practiced in our country, and following the development path of the system up to the present situation of the expropriation of the land owned collectively by farmers, this article analyzes the content of land expropriation law system in different periods, and summarizes its features during various historical stages, including the current situation. The author believes that our present collectively-owned land expropriation system descends historically from the land expropriation system constituted right after the foundation of our country, and only by taking this idea as a starting point to analysis and investigation, can we put forward scientific and practical advices to our future land expropriation reform and legislation.The paper points out the main malpractice that exists in current land requisition's policy, and on the basis of the reference of the other market economics country regions, the paper anatomize the main reasons profoundly. That is the imperfection of the property rights of collective-owned land system and defects of the current land requisition's policy. This paper put forward a frame about the reform of the land requisition in our country. The deputy of the collective-owned land' property, perfect the usufruct and set up option right in order to deepen the reform and distribute land increment income reasonable. It classed the public behalf on land into pure one and none on the base of obvious productivity, and it would solve the need for the former by taking over and the later through market.At the same time, we should strengthen the appraisal work of the collective land, definitude the main body of the income by land converting, set up a compensation pattern fit for the market economics, try to find more new ways to settle farmers down, improve the finance system.
