About The Legal System Of China's Land Expropriation

It is very popular in the world that the government makes a requisition of land for public interests, which is the radical embodiment of application of the acquisition right. Just on this foundation, Chinese land acquisition system has been founded. The land acquisition system in China was set up in planned economy period, it had done great contribution for the economic development of China. But with the transition from planned economy to market economy, in the current market economic conditions, the land acquisition system is gradually exposed various problems, it has become increasingly unable to meet the needs of economic development. So it is necessary to make a deep discussion and study on these problems, analyze its deep reasons, find a viable way to resolve it in current condition, and then improve the land acquisition system in theory and in practice.In the first chapter we explained the concept and characteristics of the land acquisition, analyzed our land acquisition system based on the reality and history ,and according to the schedule described in the order the development history of China's land acquisition system. In the second chapter of this paper we have succeed to find some problems which have been in the current land acquisition system from the respects of Land acquisition purposes and the compensation standard and the legal procedure which are three basic rules of land acquisition system, and expounded on the experience of foreign countries. On the base of adopting foreign experience and analyzing Chinese practice, in the third chapter, the author believes should be clear for development, establish the rationale for levying charges, rich content standards, bound to establish mechanisms to improve our land acquisition system, and put forward proposals and ideas.
