Protection Of The Rights Of Victims In Criminal Proceedings

Criminal victims are the counterpart of suspects and defendants in criminal procedure. While the rights of suspects and defendants are legally protected, it is important to protect the rights of victims. Suspects and defendants have implemented criminality, violated the lawful rights of victims.They must undertake the consequences—being prosecuted,brought a suit and punished by the state. With its police and army, the state's power is formidable to the suspects and the defendants. In order to balance the rights of suspects and defendants and the power of the state, the law has endowed suspects and defendants with more rights, but it has not given full attention to the rights of criminal victims. Ever since 1960s, the legal protection of human rights has come into fashion as concomitant of great changes in traditional criminal conception. The remedy of the victims, therefore, has become the focus of attention in legal circles.I think,the rights of both parts should be equally protected so as to keep them balance. The essay bases on the present imbalance resulted from neglect of the rights of victims, analyzes the deficiency and its causes in protection of victims in China, compares the legal systems of protecting victims between China and foreign countries,then puts forward measures of giving victims right of appeal,giving them state compensation and compensating their spirit loss according to the judicatory practice of China. Its aim is to bring it back for the lost balance between the rights of victims and that of suspects and defendants.
