Study On The Protection Of The Rights Of Victims In Criminal Procedure

With upgrade and development of movement of victims’ rights and study of victims, how to strengthen and guarantee procedural rights of victims in criminal action has become a hot problem concerned by theoretical and practical circles nowadays.Although The Criminal Procedure Law endows victims status of a party and relative procedural rights and makes remarkable progress in legislation in China. Because of social history tradition and legislation technical deficiencies, our current criminal procedure law still exists loopholes and defects in the protection of victims. There are still many problems both in legislation and practice hindering the implement of protecting the interests of victims and needs to be further improved.This article bases on the legal theory foundation and judicial practices, analyzing its deficiency and causes in protection of victims in our country, comparing the overseas advanced victim right protective systems, suggesting how to strengthen and improve the rights of victims in China.We should take specific measures to conceive the systems in China.The article is divided into four parts.The first part is the overview of the protection of rights of victims. This part mainly analyzes the victim’s concept, characteristics and changes of their historical status in order to have a general understanding of the victim.The second part is protecting systems of victims’ in some foreign countries. This part mainly introduces and analyzes the victim’s right protection methods and measures in the United Kingdom, the United States, France, Germany and other western developed countries so that we can facilitate our research.The third part analyzes the present situation and existing problems of victims’ rights in China. This part mainly shows the present situation, the existing problems and the reasons in protecting the victims’rights.The fourth part is system of improving criminal victims’ rights. According to our country’s judicial practice, we put forward the measures to improving the protection of victims’ rights in our country and exploring the effective ways.
