The implementation of the electronic contract is also in the topmost position of the electronic commerce. With the development of network and digital communication technology, a great number of new types of contract also come with it. Among them is the electronic contract. We can hardly implement this contract by adjusting the existing traditional contract. We need to pay attention to and also research on the new theories and practical problems. And because of the conjecture of the cyberspace, the attribute of the contract law of much behavior of network and the implementing property are very easily to be neglected by people. Therefore, starting from the theories of the right and obligation of traditional contract, I will try to analyze the implementation of the electronic contract and try to analyze from a different angle the various ways and properties of the implementation of the electronic contract. I also hope the plain analysis can do good for the whole theories about it and can function as casting a brick to attract jade.
