On The System Of Right Of Priority In Property Law

Priority bestow repaying privilege on some special obligatory right, which gets rid of equality principle of obligatory right on purpose, and reflects equality and justice of legislation. But it is ignored in our country.This article elaborates name and concept of priority and character of legal real right for security with historical and analyzed way. The writer refers the system to the other countries, especially German and Japan ,and sums up the advantage and shortcoming of it, that give us reference. We should establish the system of priority and formulate concrete regulation in our country, and the writer advances some supplementary suggestions on frame of priority of Professor Wang Liming, and hopes that it can develop and consummate the system of priority, and have common understanding between theory and legislation.
