The Chinese constitution pioneers uphold the right of the nation, and neglected the protection of individual rights, which led to the long-time dying of Individualism. People's political judging capability was too weak that all constitutional contracts could not be achieved. Now we are apprehending the Western constitution theory under the circumstances of Chinese holism. The essence of the Western constitution takes individual rights and freedom as its bottom line. In this article, the author proposes the theory of Constitutional Atomism. It is not simply a stressing of pirate atomistic individualism, but a pointing-out of the lack of understanding of the essence of Western constitutional individualism.
