Study Of Food Safety Regulation And Administrative Law Enforcement System

In recent years, food safety incidents are becoming more and more serious in the whole world, some serious food security incidents also often happen even at some developed countries like USA, Japan, England and German. The current status of food security in our country is more bothersome, the serious status of which is beyond doubtful. And the food security issue is always a focus issue during the meetings of National Congress in recent years; food security issue is also highlighted as a focus issue in recent years' "National Key Working Points of Neatening and Criterion of Market and Economy Order" issued by the State Council.There are relatively deep and intensive studies in the field of administrative management of food security in foreign countries, but studies especially focuses on system of legal administrative execution are relatively less. In terms of our country, we are lack of systematic and well arranged study in the field of administration of food security, and relevant study and results are quite weak, which intensively contrasts to the more and more focuses on food security study by developed country. Therefore, the study on system of legal administrative execution in respect of food security with Chinese character will be of great importance both theoretically and practically to secure the health of our people, to maintain the social stability and to promote international trade in respect of food industry.Current, scholars in our country are more likely to study food security issue from the point of economic law, while studies from aspect of administrative law on food security issue are relatively less; and the above relatively less studies are mainly from one aspect, like from the angle of one administrative department, or from the regulation point of view. However, without proper and efficient legal administrative execution, even perfect regulations could hardly be realized. And in the actual practice of food security administration, many problems are initiated due to the cross and segmentation of deferent departments, which is the key to lead to the low efficiency of administrative execution over food security in our country. Therefore, it will be of great value both theoretically and practically to study the execution system to settle the contradiction of department authorities and to discuss the comprehensive legal execution and legal execution system of department authorities. Therefore, with reference to advanced experience of other countries in the field of legal administrative execution on food security, the author attempts to probe into establishment of the efficient system of legal administrative execution over food security to provide certain reference for solution of our food security problem from the aspect of legal administrative execution.Based on the study on advanced experience of developed countries in the field of legal administrative execution on food security, considering the special status of our country, the author brings forward several thoughts on the perfection of system of legal administrative execution of our country.
