Banking plays a vital role in China's economy, for it can help stabilize social system and boost economy. For a long time, monopoly has been a trouble for China's banking industry, which results from the high barriers to banking market, lack of effective supervision and unjust financial policy. The monopoly situation of banking has been a serious violation of consumer rights, undermining the fair and free competition, and damaged the interests of small and medium-sized banks. Meanwhile, this situation leads to the inefficiency, lack of business activity, failure to innovate and weak competitiveness in the banking industry. With more foreign banks entering in, China's banks confront enormous challenges. Therefore, the restriction to the monopoly of China's Banking is of great realistic significance.With the use of empirical research, these dissertations give in-depth analysis to the cause of the monopoly, on the analysis of abuse of monopoly power and the two forms of monopoly in China's Banking. Furthermore, combined with this dissertation advances the following recommendations to perfect anti-monopoly laws: At first, it is urgent to set up a independent organization to regulate banking industry, which can help solve the problem that no departments are given full legal status to supervise; Secondly, China needs to improve litigation system for personals which will endow people with the right to indict the banks with monopolistic behaviors; Thirdly, the fair rule of market access should be worked out to create a fair financial environment, which can do a great help to eliminate monopolistic phenomenon; Finally, information disclosure system should be established to ensure efficient operation of the banking industry.
