The Rules Of Logic And Political Parties In The Party Constitution

Party constitution is considered as the fundamental law in a party, it is very important without saying, especially to the Communist Party of China (CPC),which owns more than 73,000,000 members, The importance of constitution towards the existence and development and CPC needs to be paid high attention. However, the constitution of CPC does not play as a fundamental law like a constitution in a state in practice, the problem deserves our thinking, and in the sophisticated international and national situation, it is very necessary to make all organizations in different levels and all members act in the light of party constitution. According to the basic rules of organization running, this article takes Marxist standpoint, viewpoint and method as the guide, analyzes Party constitution and related problems more objectively from the angle of the relation between organization and rule, which hopes to improve the functions and effects of Party constitution in Party's building under new historical condition.This article is composed of three parts: first, it starts with the principal theory between organization and rule, gets common sense between party and constitution, on the base, it further analyzes the condition of party constitution should be in modern democratic politics, at last, it discusses the existing problems during the development of the constitution of CPC, just as follows:The first part mainly analyzes organization rules and their principal logic through applying histology, politics, sociology and so on, it first talks about the definition and characteristics of organization, then discusses rules and their functions to organizations, and studies some objective factors influence rules in organizations.The second part mainly analyzes party constitutions in modern party politics which are should be. Party is a kind of organization, therefore it has its fundamental characteristics, but it is not the same as common organizations. Party constitution is the most fundamental rule for a party, and generally it is a kind of organization rule, it indicates the value of a party, regulates the actions of its members, ensures a party act as a whole, and realizes its aim and interests. Besides, party constitution is influenced by party's scale and structure, the time of constitution's existence and the party's external environment.The third part analyzes the constitution of CPC concretely. It argues that, after several revised edition since the party's establishment, the constitution of CPC has got great improvement on the basis of socialism modernization construction, has embodied the theory demand of keeping pace with the times, and has directed for Party's building and holding the power for long time. At the same time, there are some problems in existing constitution, for example, the aim written in it needs to be more attractive. This part also explains the reasons for these defects, for example, from era angle, under the condition of socialist market economy, multiple material benefits impact on the aim of the Party; from history angle, revolution thinking, the scale, structure of CPC, the existing time of CPC constitution and historical and cultural tradition influence the constitution, too. At last, the article makes some suggestions to perfect and carry out the constitution in practice on the basis of the fundamental logic of organization rules.
