The Organic Unity Of Ruling The Country By Law And Governing The Party By Rules:The Practical Logic Of The Rule Of Law In China

The report to the 19th National Congress of the Communist Party of China(CPC)pointed out that we should adhere to the organic unity of governing the country by laws and governing the party according to rules and take it as an important part of the basic strategy of upholding and developing the socialism with Chinese characteristics in the new era.In the new era,law-based governance of the country and the party are the wings of the rule of law in China.Their respective values,relations and organic unity are of great significance to advancing the comprehensive strict rule of law of country and the party,as well as to modernizing China's governance system and capacity.Based on this,this paper focuses on the theme of national modernization and grasps the organic unity of rule of law and rule of party from the following three pairs of relations: the relationship between political party and rule of law,the relationship between party leadership and rule of law,and the relationship between rule of law and rule of the party.Based on the status of political parties in a country ruled by law,the relationship between political parties and the rule of law,and the actual governing law of political parties in a country ruled by law,this paper discusses the necessity of the rule of law of political parties in China;Starting from the core of the socialist rule of law,this paper analyzes the relationship between the leadership of the party and the rule of law,and analyzes that the rule of law and the rule of the party under the leadership of the party are two "hands" in the construction of socialist rule of law;Through the differences,commonness and mutual relationship between the rule of law and the rule of the party,this paper analyzes the urgency and necessity of their organic unity;Illustrated by using the method of historical analysis,in accordance with the law and in accordance with the rules governing the party unity of historical evolution,analyzes the problems between the two organic.Based on all of the analysis,this paper puts forward the ways of realizingthe organic unity of rule of law and the rule of the party: First,to realize the organic unity of the party's leadership,people as the masters of the country and rule by law in China with the guidance of Xi Jinping thought on socialism with Chinese characteristics for a new era;Second,to set up the concept of the supremacy of party rules,and through strengthening the party's system construction,improving decision-making,implementation and supervision and other restraint mechanisms,to further realize the rule of the party in the construction of intra-party democracy;Third,to promote and realize the organic unity of governing the country according to law and governing the party according to rules in the process of deepening the construction of legislation,filing and examination system.Fourth,seize the key minority of party members and cadres to promote law abiding by all.
