On The Logic Of Chinese Rule Of Law Politics

The rule of law,as a way of national governance,is being recognized by all countries.In the process of the implementation of the rule of law,although the depth and breadth of different countries,but with the development of history,the concept of the rule of law is increasingly popular.In contemporary China,with the development of domestic economy and society and the continuous evolution of economic integration and cultural exchanges between China and the west,the rule of law has increasingly become the common pursuit of the Chinese people's way of national governance.However,with the reform entering a critical period and anti-corruption entering a deep water zone,China's socialist rule of law is facing a grim situation.The contradiction between the party and the rule of law is becoming more and more acute,so that the question of "the party is still the law" and "the power is still the law" is rampant.This paper takes this as the starting point of the study,and concludes the relationship between the party and the law as the relationship between politics and the rule of law.At the same time,the unique perspective of anti-corruption is introduced in the process of combing.Through the detailed data and materials in the process of anti-corruption struggle and rule of law in China,the logic of rule of law politics is positioned more accurately,and then the rational prospect system of rule of law politics is outlined.The composition of the paper is mainly based on the following three aspects:First,by sorting out and defining the theoretical origin and related concepts of corruption and corruption governance,rule of law and rule of law politics,this paper reveals the internal correlation between rule of law politics and corruption governance,and establishes the research on a solid theoretical basis,which provides the premise and theoretical support for the research of this paper.Second,the rule of law as a way of national and social governance,its form and mode is not a single.Based on the differences in specific political,economic,cultural,historical and traditional conditions as well as the governing ideas pursued by different countries,each country chooses its own governing mode that highlights its national spirit through rational thinking.When discussing the connotation of the rule of law in China,on the basis of learning from the beneficial elements of the western model of the rule of law and integrating China's contemporary national conditions,the connotation of "rule of law politics" is summarized as the organic unity of the leadership of the party,the position of the people as masters of the country and the rule of law.Third,from the overall perspective of the rule of law process of anti-corruption practice since the founding of the People's Republic of China,this paper carefully sorts out the changes of anti-corruption mode and the social governance concept reflected by it since the founding of the People's Republic of China,as well as the process of rational growth of the anti-corruption governance system.It affirms the three major advantages highlighted in the deepening process of China's anti-corruption drive,namely the core leadership role of the CPC,effective forms of democracy and institutional arrangements,and the manifestation of the rule of law.Fourth,based on the analysis and summary of the practical experience of anti-corruption in China,the author deepens the understanding of the political implications and institutional forms of the rule of law,and thus concludes the logic of "rule of law politics".First,the party's leadership is taken as the initial logical starting point.The whole process of the rule of law in contemporary China cannot be separated from the leading role of the CPC,and it depends on the political authority to provide order guarantee.Second,the rule of law authority as the logical end of the results.Third,the principle of taking the people as the main body and the goal and appeal will run through the party's political construction under the leadership of the rule of law.
