| Real estate development refers to the infrastructure and house construction by acquisition of land-use right according to laws, of which the land development and real estate construction is the object to invest. This thesis begins from introducing the concept, characteristics of real estate cooperative development contract, and then concerns on the validity of it. Through the analysis of relationship between real estate ownership and land right in German and Japanese civil codes and of legislative model of unifying the subjects of real estate ownership and construction land use right, the thesis examines the problem of real estate ownership in China's real estate cooperative development. Other issues of real estate cooperative development are also touched. By the explanation and analysis of above said issues, the author provides some solutions and legislative suggestions for the prevention of cooperative development contracts disputes, the dispute resolution of cooperative development contracts, and the balance of interests of each party. |
