The system of Cun Liu Yang Qin is unique in Chinese feudal society, generally applicable to all sectors of a special legal system. In ancient China it refers to some persons were sentenced to death or exile, or imprisoned, their elderly parents, grandparents, have no one to take care of the their life, and the persons have no adult children and grandchildren, so the prisoners will not be executed to the original verdict but allow they care their relatives and wait their relatives die after implementation or revision of the penalty system implementation. Its aim is to protect and reflect the feudal ethics. Retention pro-custody system in existence for 1,400 years, the existence is reasonable and inevitable. From the implementation of it, it made a detailed history of the Code provides that a strict application requirements and procedures, making the possibility of criminal indulgence was to a minimum. And because it is there, making elderly people caring, and maintaining social and family stability and in the interest of criminal probation and will be more conducive to feudal monarchs to rule. Today, the construction of a modern rule of law in our country in the process, not only to absorb the advanced Western theories of the rule of law, but also must combine our traditional legal culture. Although as a legal system, it has lost its basis for the existence of, the system as embodied in the humanistic spirit, as well as the concept of filial piety to the social order and security are worth the value of our exploration, and more important is the system of China has an important reference to reform of our probation system and make it more perfected.
