China's Military Compensation System Build

Military compensation system is a kind of legal systems that our country will give compensation when national military departments and their staffs infringe the citizen, corporation and other organization's legal rights to cause losses as their executing authority illegally and by mistake. Nowadays, our country's military compensation system is still in vacancy in legislation, and Military compensation problems still exist greatly in practice, there out in practical dealing process lawlessness in judicial practice and continuous dispute come forth in a embarrassed situation. This is not favorable to maintain the dignity of the constitution, safeguard the citizen, corporation and other organization's legal rights, and also implement the administration according to law and governing the Army according to law. Therefore, based on military administration practice, combined with the relevant laws and regulations, used related theoretical study results for reference, this paper puts forward systemic research and analyses on the construction of military compensation system, so as to provide theoretical support for military compensation legislation, accordingly to promote early foundation of our own military compensation legal system and further improve national compensation legal system.
