Intellectual property rights can be pledged by the transfer of intellectual property rights and set the target of the right to be secured creditor's legal system, which crests the condition for the realization of the value of intellectual property rights exchange. However, because existing intellectual property system is not sound security pledge in china, theoretical study is not thorough enough, lack of the main market awareness and financial institutions and of practical experience, intellectual property rights as an alienable property rights in china also did not become an important means of security.In view of the above background, I research the existing intellectual property legal system, aiming at a detailed interpretation of the legal guarantee of intellectual property rights pledge theoretical system, and exploring an additional way to pledge of security and improve our legal system and practice rules.This paper is divided into five parts:PartⅠ: Introduction to intellectual property rights pledge. It firstly described the concept of intellectual property, and legal character of the right to pledge on the concept of the subject matter and legal features of the security functions carried out a comprehensive analysis.PartⅡ: Intellectual property pledge on the subject. Apart from that part of the existing law expressly provides for the pledge on intellectual property, the law does not clearly defined but was possible pledge analyzed, at the same time, but also related to intellectual property rights and other rights to quality issues research and study.PartⅢ: The establishment of intellectual property rights pledge, change , termination. The main part draw of the pledge of intellectual property rights on the set procedures, intellectual property rights, the legal features of the contract pledge, the pledge of intellectual property rights and termination of the change to a brief analysis of the situation.PartⅣ: The legal effect of intellectual property rights pledge. The part of the in-depth analysis of the rights and obligations, in particular the current law has not been a clear issue of the rights and obligations of the study.PartⅤ: China's intellectual property practice pledge secured confusion and outlet. Some pointed out that current system of intellectual property rights secured under the pledge, and the authors on the improvement of the intellectual property system security pledge and several thoughts.
