The collegiate Panel is the fundamental judicial organization of the people's courts and The Operating Mechanism of the Collegial Panel is the basic judicial mode.The reform of The Operating Mechanism of the Collegial Panel is a complicated systematic project,for its reform will stir up all other court reforms which will in the long run be demonstrated in the case trials through collegiate panels or independent courts.The Operating Mechanism of the Collegial Panel reform concerns internally the structural layout of court power and externally the state political systems and the relationships with the Party Committee,People's Congress and the government.The Operating Mechanism of the Collegial Panel reform demands the effective support and cooperation of all relevant departments can not be expected to achieve exclusively in the judicatory departments.At the same time,the reform on the collegiate panel system should be aimed not only to the future but also to the reality.We can never blindly copy the Western modes but base on China's characteristics and follow a step by step principle and polarized steady promotion to avoid possible chaos. Thereby,this paper,from the perspective of civil justices,based on carefully analyzing current conditions of our country,points out the major disadvantages of the current legislation and ideological faults. In reviewing the problems this paper propose some reform schemes for problems in regard to the horizontal operating mechanism and vertical operating mechanism.
