21st century has become a century of information cored with computer network; characterized by digitalization and networking. As computer and internet have been speedily developed and widely used, development of information industry has moved on a fast space and continuously promoted financial electronization process. E-banking has eventually emerged as a product of financial revolution, therewith low cost, high efficiency, convenience and wide application, E-banking has demonstrated a strong vitality and emergence of E-banking has greatly enhanced productivity of financial services. Nevertheless, one coin always has two sides; along with a series of institutional movement and unprecedented opportunities for development to traditional banking brought by emergence of E-banking, unparalleled risks to banking industry has simultaneity emerged. These risks have considerable impacts on banking industry's steady operation and created great challenge to the existing financial legal and regulatory system at the same time. Therefore, Guarding against and control E-Banking risks, guaranteeing financial industry's safe operation would be the urgent issues to be resolved. This dissertation will carry out an analysis adopting operational , compatibles and institutional methods to give a study on legal and regulation issue of E-bankingThis essay comprises five sections.In this first section, it is going to present the emergence, concept, and character, types and development trend of E-banking.The second sections would analyze various risks and features of risks, that E-Banking faces in development, hence to explore the causes of risk and emphasis the necessity of intervention of laws and regulations.The third section would give out an analysis of relationship between E-Banking Business and Laws.The forth section would focus on risks of E-banking from both safety of transaction and from the point of macro (regulatory supervision) views, a deepen analysis is given out in the fifth section, Referring to other countries' mature experiences in regulating E-Banking and fast growing condition of domestic banking industry, various suggestions have been raised for improvement of our country's regulation on in this section.Relevant legal and regulation guidelines are still missing in our country's E-Banking system, therefore, this essay is referring to other counties' advanced experiences on E-Banking regulation and based on the practical situation in our country, from a juristic view, this dissertation is aiming to rise suggestions to improve our country's Laws and regulations on E-Banking Business and create a framework for a standardized [E-Business Law] which could be applied to regulating on-line banking and phone banking, hence to provide legislators an expansive thought to improve the stability and healthy development of our country's E-Banking business.
