Health Foods, known as the series of foods products with functions resembling both natural foods and medical consumptions, has direct impact on the citizen's health and safety, and therefore must be regulated and supervised under the related government agencies. China's health foods policies and regulations were originated in 1990's, in order to regulate its fast growing foods industry. However, the resulted long term effects are not necessarily satisfying. In July 1st, 2004, Chinese government passed the People's Republic of China Administrative Licensing Law. This law becomes one of the milestones marking a significant progress of China's legal system, and also significantly improves the regulations of various administrative licensing within the head foods industry. However, there still exist many problems associated with the administrative licensing which simply cannot be resolved by the law alone. Furthermore, because of the imperfection within the associated laws, regulations, and supportive system, there are still many issues related to the heath foods administrative licensing, such as misusing and abusing the licensing system, lack of supervision, etc., which largely prevents us from reaching the ultimate goal of building the administrative licensing system.So far, very few researches have been done on China's heath foods administrative licensing system. From the perspective of fundamental theories of administrative licensing, by using literature researches, empirical study, comparative study and other study methods, this paper aims to provide an overview as well as in-depth analysis on China's health foods administrative licensing system, describe the existing conditions, explore different alternatives to improve the system, and finally to propose viable solutions to improve the system. The entire paper comprises of three chapters:Chapter 1 The theoretical foundation of health foods administrative licensing system. The paper presents the concepts and legal bases for the health foods administrative licensing system, describes its features and functions, and hence highlights the purpose of establishing the heath foods administrative licensing system.Chapter 2 The existing conditions of health foods administrative licensing system. Based on the People's Republic of China Administrative Licensing Law and by using some case studies, the paper analyzes the applicable areas, limitations, applicable entities and implementation procedures of heath foods administrative licensing system, and identifies the existing problems within the legal system of health foods administrative licensing.Chapter 3 The proposals to improve the heath foods administrative licensing system. To address the existing problems within the legal system of health foods administrative licensing, the paper proposes five solutions: 1) To step up the legislation for health foods administrative licensing. 2) To improve the health foods administrative licensing system. 3) To improve the supportive system for health foods administrative licensing. 4) To build the correct concept. 5) To establish the credit system for administrative licensing. In the end, through the evaluation of administrative licensing system within several foreign countries in junction with China's realities, the paper proposes several viable ways to reform the existing heath foods administrative licensing system, including potential reformation categorical administrative licensing, decomposition administrative licensing, and so on.
