The thesis is on Chinese University Autonomy Legal System.It reveals the science and significance of this legal system in law terms,emphasizes the basic legal theory from three aspects:1.University's corporate position.University is a independent corporation entity,the relation between the government and university is loose plan-autonomous rule.2.University's autonomy.It is the core of university autonomy legal system.Its range is broad,university should be authorized the right that is beneficial to a university self-government and not forbidden by law. University has last word in creating its headmaster,at least can pairticipate at high degree.3.The university self-government structure.The autonomy must be decentralized into three parts:decision-making power,executive power, supervisory power,each one is authorized to one organizatiom only,according to corporate management structure.It guards against the right unbalance and propagating sepsis,beneficial to studying and research at easeIt introduces modern Chinese university legal system.Since the foundation of PRC to 1978,chinese university was not a corporation,the government controlled university's most affair.After the reform and openning,university became a corporation,has been expanding the decision-making right running a school from the government.The thesis appraises the deficiency in current university legal system of china. Because the law' s guiding ideology—expanding a university' s decision-making right—is gone against the development of university,university is interfered with arbitrarily more than the correct or required number by the government and is prevented from running autonomously.A legal person status of University is distorted,university is short of independent spirit.University's right range is very narrow,administration influence is so powful that learning thought is inhibited,university has lost learning freedom.The thesis provides countermeasures and suggestions:take academic freedom as target,found a university autonomy legal system.University is an independent corporation,enjoys the sufficient autonomy,founds corporate management structure.Such university makes prosper because it is able to boycott the outside interference,teacher and student can participate in school affair freely, arouses academic activity enthusiasm,promoting learning.
