Companying with the Reform and Opening-up process of China,the Price-fixing Cartels Initiated by the Trade Associations(PCITA) becomes comparatively universal.To guarantee our Socialist Market Economy,those cartels which have undermined the fair competitions in the market,the efficiency of the economy,as well as the interests of both the consumers and the public,should be regulated by the anti-monopoly law.The Anti-monopoly Law of the People's Republic of China,proclaimed on August 30th,2007,would come into force on August 1st,2008.In this dissertation,the author analyzed the explicit categories of the Chinese PCITAs,and also their implicit causes of formation.Then she evaluated the former regulations before the Anti-monopoly Law in China, investigated the anti-trust legislations in other countries and regions, and elaborated her suggestions for the consummate of the Chinese anti-monopoly process:-synthetically evaluating "certain trading scope","validity of information exchange"and"virtual limitation"to distinguish illegal PCITA;-civil liabilities,administrative liabilities and criminal liabilities to be born by illegitimate trade associations;punishment to be cast upon individuals at the same time;civil compensation to be raised;-immunities for certain PCITAs;-to constitute the Trade Association Law etc.
