Abstract/Summary:
Economic democratization is being activated as Korea and other countries promote economic stabilization.Accordingly,many laws and regulations directly and indirectly related to the economic structure and economy are expected to be reorganized.In particular,the Monopoly Regulation and Fair Trade Act(hereinafter referred to as the "Fair Trade Act"),one of the most notable laws related to the economic structure and operation of the Republic of Korea,will also change and improve in many ways.Among them,"free and fair market economy" and "seeking consumer benefits" are key in the field of fair trade.Therefore,social requests for the establishment of a fair society have expanded,and research on the legal basis of fair competition,including cartel regulations under the Fair Trade Act,is needed more than ever.Today,due to the internationalization of cartels and the expansion and seriousness of their damage,law enforcement on cartels is strengthening internationally.In light of the active discussion on international standardization of competition policy and international harmony of competition laws,it should be emphasized that Korea’s unfair joint action regulation system needs to be continuously improved and supplemented.Korea and China are important countries to each other,and political exchanges and economic relations between the two countries need to be close.China’s antitrust law will serve as a standard for competition between companies in the two countries.In addition,since China’s antitrust law needs to be revised and supplemented,or in order to promote sound transactions between the two countries in the future,China’s antitrust legislation should refer to the experience of legislation and law enforcement and should be innovated through advanced technology.
