Therefore it inevitably leads to various disputes and problems. Military compensation leads a lot of phenomena without law , which have already become a significant problem both to army, which directing troops according to law, and to administator ,which performing official duties according to law.For laying down the burden of the force, and going on the regular military training, and be easier for people to compensate according to law reasonable and legitimate, the conflict balancing, resolving benefit, upkeep social stability ensuring host object both sides lawful rights and interests and main benefit thereby, reach the purpose fixing mark stop arguing, putting down contradiction , promoting harmony , accelerate the compensation carrying out military affairs be obliged to ultimately legislation.This paper keeps foothold in problem of military compensation recent years, according to the present stage national conditions of our country and military , analysing primor problems existed combining with examples; This paper takes the beneficial experience of compensates of foreign army as a mirror, and sums up their main idea and rationale of legislation of compensation.
